Welcome to MYLY. The terms "we," "us," and "our" refer to MYLY Studios ("MYLY"). MYLY is a proprietorship that operates this store and website, including the related information, content, features, tools, products, and services (collectively, the "Services"). MYLY is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, warranties, returns, limitations of liability, and other matters.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access the Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your place of residence and that you have the legal capacity to enter into these Terms. If you permit a minor to use the Services, you are responsible for their use of the Services.
To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing, payment, and shipping information. You agree that the information you provide is accurate, current, and complete and that you have the right to provide it.
MYLY does not require customers to create an account to place an order. If account functionality is made available in the future, you will be responsible for maintaining the security of your account credentials and for activity conducted through your account.
SECTION 2 - OUR PRODUCTS
MYLY creates personalized children's decorative wall art, including personalized prints and framed prints. We make reasonable efforts to display product images, colors, sizes, and other product information accurately. However, colors and appearance may vary depending on your screen, device, settings, and lighting.
Because MYLY products are personalized and made to order, the final product may have minor variations in color, texture, positioning, or appearance that do not materially affect the product.
Personalization is based on the information submitted by the customer. Customers are responsible for checking all names, initials, spelling, capitalization, and other personalization details before placing an order. MYLY is not responsible for errors in personalization caused by information submitted incorrectly by the customer.
Product descriptions, availability, designs, sizes, and other product details may change from time to time. MYLY reserves the right to discontinue products or limit quantities or availability in particular countries or regions.
SECTION 3 - ORDERS
When you place an order, you submit a request to purchase the selected product. An order is accepted when MYLY confirms the order and payment has been successfully processed.
Please review your order carefully before submitting it, particularly all personalization details. Because personalized products are made to order, cancellation requests may not be possible once production has begun, subject always to any cancellation rights required by applicable law.
If MYLY is unable to accept or fulfill an order, including because of an error in pricing, product availability, personalization, payment, or shipping eligibility, MYLY may cancel the order and will notify you using the contact information provided with the order.
Your purchases are subject to the rights and remedies described in our Refund and Cancellation Policy [LINK] and any mandatory rights provided by applicable law.
SECTION 4 - PRICES AND BILLING
Prices are displayed in USD and may change from time to time. The price charged will generally be the price shown at the time the order is placed and confirmed.
Applicable taxes, duties, or other charges will be calculated and collected at checkout where required by applicable law. Where MYLY or its fulfillment provider is required to collect applicable taxes, duties, or import charges, these will be handled accordingly. We will not knowingly describe a charge as included or excluded where applicable law requires otherwise.
Shipping is included in the product price unless otherwise stated at checkout or on the relevant product page.
You agree to provide accurate and complete payment information and to promptly update information necessary to complete your transaction. Payments are processed through Shopify and our payment service providers, including PayPlus, and may also be subject to the terms and policies of those providers.
SECTION 5 - SHIPPING AND DELIVERY
MYLY products are made to order. MYLY generally prepares personalized artwork for fulfillment within approximately 2 business days. Orders are then fulfilled and shipped by our third-party fulfillment provider.
Delivery times are estimates and may vary depending on destination, carrier, customs processing, and other circumstances outside MYLY's reasonable control. Total delivery may take up to approximately 2 weeks depending on the destination.
MYLY includes shipping at no additional charge unless otherwise stated at checkout.
Where our fulfillment provider offers delivery with duties and taxes paid (DDP), applicable duties and import taxes are handled through that arrangement. If a charge is imposed that MYLY or its fulfillment provider is legally responsible for collecting or paying, MYLY will handle it as required by applicable law.
If an order is lost or arrives damaged, please contact us at hello@myly-studio.com. Where appropriate, MYLY will work with its fulfillment provider to provide a replacement in accordance with our Refund and Cancellation Policy.
MYLY is not responsible for delays caused by events outside its reasonable control, including carrier delays, customs processing, weather, natural disasters, strikes, governmental actions, or other force majeure events. Nothing in this section limits any rights you may have under applicable law.
SECTION 6 - INTELLECTUAL PROPERTY
The Services and their content, including MYLY's artwork, designs, graphics, text, logos, product names, photographs, videos, and the design and arrangement of the website, are owned by or licensed to MYLY and are protected by applicable intellectual property laws.
You may access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, or commercially exploit MYLY's artwork, designs, branding, or other protected content without MYLY's prior written permission.
Purchasing a MYLY product does not transfer ownership of MYLY's underlying artwork, design, copyright, trademarks, or other intellectual property rights to you. All rights not expressly granted are reserved by MYLY or its licensors.
MYLY's name, logo, product names, designs, and slogans are trademarks or trade names of MYLY or their respective owners. Shopify's name and trademarks belong to Shopify.
SECTION 7 - OPTIONAL TOOLS
We may provide access to third-party tools or features as part of the Services. Such tools are provided by third parties, and MYLY does not control or operate those third-party services.
Your use of third-party tools may be subject to the third party's own terms and policies. To the extent permitted by applicable law, MYLY is not responsible for third-party tools or services that we do not control.
Any new features or tools added to the Services in the future will also be subject to these Terms unless otherwise stated.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to third-party websites, services, or content. MYLY does not control and is not responsible for third-party websites or services. If you access a third-party website, you do so at your own risk and should review that provider's terms and privacy policies.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
MYLY is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through our Store are transactions between you and MYLY. Shopify is not responsible for products sold by MYLY or for the fulfillment of orders placed with MYLY, except as may otherwise be required by applicable law.
SECTION 10 - PRIVACY POLICY
Personal information collected through the Services is handled in accordance with our Privacy Policy [LINK]. Because our store is hosted by Shopify, Shopify may also collect and process information about your use of the Services in accordance with Shopify's privacy practices. Information may be processed or transferred to service providers in countries other than your country of residence as necessary to operate the store, process payments, fulfill orders, provide customer support, and otherwise provide the Services.

SECTION 11 - FEEDBACK AND REVIEWS
If you voluntarily submit reviews, feedback, suggestions, photographs, or other content to MYLY (collectively, "Feedback"), you represent that you have the necessary rights to submit that content and that it does not violate the rights of another person.
By submitting Feedback, you grant MYLY a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that Feedback for purposes of operating, improving, and promoting MYLY and its Services, subject to applicable law.
MYLY will not use customer photographs, names, or other identifiable customer content for marketing purposes unless the customer has given explicit permission to do so.
MYLY may remove Feedback that is unlawful, misleading, abusive, defamatory, obscene, infringing, or otherwise inappropriate.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
There may occasionally be information on the Services containing typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, or delivery times. MYLY reserves the right to correct such errors and update information.
If an error materially affects an order, MYLY may contact you and, where appropriate, offer the option to confirm the corrected order or cancel the affected order and receive a refund of amounts paid for that order.
SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes. You may not use the Services to violate applicable laws, infringe intellectual property rights, transmit malicious code, impersonate another person, submit false information, interfere with the operation or security of the Services, or engage in conduct that harms MYLY or other users.
You may not use automated systems, scraping tools, bots, agents, or other automated means to access or extract substantial portions of the Services without MYLY's prior written permission, except where access is expressly permitted by applicable law or by a technical mechanism provided by MYLY.
MYLY may restrict or terminate access to the Services where reasonably necessary because of misuse, fraud, security concerns, or a material violation of these Terms, subject to applicable law.
SECTION 14 - AGENTS
14.1 This section applies if you use or cause an automated or semi-autonomous software agent to access, use, or interact with the Services.
14.2 Agents must not conceal that they are automated, circumvent security measures or CAPTCHAs, misrepresent themselves as human users, or access the Services after MYLY has requested that they stop.
14.3 MYLY may use reasonable technical measures to limit or control automated access to the Services.
14.4 Any automated access must comply with applicable laws and MYLY's technical access controls and must not interfere with the Services or other users' access.
SECTION 15 - TERMINATION
MYLY may restrict or terminate your access to the Services where permitted by applicable law if you materially breach these Terms, engage in fraud or abuse, or use the Services in a manner that may harm MYLY, its service providers, or other users.
Termination does not affect rights or obligations that arose before termination or provisions that by their nature should continue to apply, including Intellectual Property, Privacy, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and these Terms' dispute-related provisions.
SECTION 16 - DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services are provided on an "as available" basis. MYLY does not guarantee that the Services will always be uninterrupted, timely, secure, or error-free.
Nothing in these Terms excludes, restricts, or modifies any warranty, guarantee, consumer right, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law.
SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, MYLY and its service providers will not be liable for indirect, incidental, special, or consequential losses arising from your use of the Services or products purchased through the Services, except where such liability cannot lawfully be excluded or limited.
Nothing in these Terms limits liability for matters that cannot legally be limited or excluded, including liability arising from fraud, intentional misconduct, or any mandatory consumer rights or remedies.
SECTION 18 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify MYLY and its service providers against third-party claims, losses, or reasonable costs arising directly from your material breach of these Terms, unlawful use of the Services, or infringement of a third party's rights through content you submit to the Services.
This section does not require you to indemnify MYLY for losses caused by MYLY's own unlawful conduct or for any liability that cannot lawfully be transferred to you.
SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law, and the remaining provisions will remain in effect.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
MYLY's failure to enforce any provision of these Terms does not constitute a waiver of that provision.
These Terms, together with the policies expressly incorporated into them, constitute the agreement governing your use of the Services and supersede prior versions of the Terms relating to the same subject matter.
SECTION 21 - ASSIGNMENT
You may not transfer your rights or obligations under these Terms where doing so would materially affect MYLY's rights or obligations without MYLY's prior written consent. MYLY may transfer or assign its rights and obligations where permitted by applicable law.
SECTION 22 - GOVERNING LAW
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Any dispute will be subject to the jurisdiction of the competent courts in Israel, subject to any mandatory jurisdictional or consumer-protection rights that apply to you under applicable law.

Section headings are provided for convenience and do not affect the interpretation of these Terms.
SECTION 24 - CHANGES TO TERMS OF SERVICE
You can review the most current version of these Terms at any time on this page. MYLY may update these Terms from time to time by posting an updated version on the website. Material changes will be handled in accordance with applicable law. Your continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.
